Officer's duties; he has reported him for insubordination and inefficiency. The discussion as to the nature of those duties lies with the Chief Justice and the Government. And in this connexion I must point out that unless the Chief Justice were the Registrar's official Chief there would be no one to report his inefficiency to the Government.

With regard to the recommendation that Mr. Seth be suspended from office for insubordination I have the honour to point out, that in the case of most other officers, When they are brought before the Executive Council, the Head of the Department is present and in the main conducts the enquiry, and advises the Executive Council on the matter. If the question of Mr. Seth's conduct should be brought before the Executive Council I must request Your Excellency to allow me to be present to fulfil the same duty towards the Executive Council as any other Head of Department in similar circumstances.
But in any circumstances I must claim to advise Your Excellency on the question, not as a party to a dispute, but as Head of the Supreme Court.
In paragraph 4 of Your Excellency's letter of 9th. April, you observe that Mr. Seth is fully sensible of the duty he owes to me in supplying me with such information as I may desire regarding the efficiency of the staff of the Registry. I feel sure that Your Excellency did not in this para- -graph mean to suggest that I am not aware what his duties are in this respect, which would imply that Your Excellency has already decided that Kr. Seth's conduct meets with Your Excel- -lency's approval.

I submit that the question with regard to Mr. Seth's conduct, can be put within a narrow compass. On the basis of the above paragraph of Your Excellency's letter, Mr. Seth owes certain duties to the Chief Justice. I assume for this purpose that the Chief Justice requested him to do some – -thing which lay outside those duties. The question which then arises for Your Excellency's decision is whether it was proper
